Steps Borrowers Must Take Against Fake Recovery Agents

The financial stress of a loan default should never be compounded by fraud, intimidation, or abuse. Unfortunately, fake and malicious recovery agents are a growing menace, often exploiting fear and confusion to execute scams.

Step 1: Verify the Agent’s Identity—The First Line of Defense

 

A legitimate agent is required to follow strict, ethical guidelines. A fake agent will refuse to cooperate with verification.

Red Flag (Immediately Suspect Fraud) Borrower’s Action (Demand This Information)
Refusal to Identify Demand the agent’s full name, employee ID, and the name of the agency they represent.
No Authorization Letter Demand to see a physical or emailed authorization letter from the Bank/NBFC itself, authorizing them to collect.
Demands for Cash/Personal Transfer Insist that all payments must only be made to the official bank/NBFC account. Never pay cash or transfer to a personal UPI/bank account.
Calls Outside of Hours Agents are only allowed to contact you between 7:00 AM and 7:00 PM. Contact outside this window is a violation.

Immediate Action: If an agent fails to provide proper credentials or demands an irregular payment method, terminate the communication immediately and proceed to Step 2.

 

Step 2: Document Everything—Your Agent Harassment Log

 

Proof is vital. Every call, text, or visit must be recorded as legal evidence.

  1. Maintain a Detailed Log: Keep a physical or digital record of every interaction, noting:
    • Date and Time of the call or visit.
    • Phone Number the call came from (and save screenshots of texts/WhatsApp messages).
    • Agent’s Name and Agency (if they provided one, even if you suspect it’s fake).
    • Nature of Harassment: Record the abusive language, threats, or intimidation used.
  2. Gather Digital Evidence:
    • Take screenshots of threatening messages or public shaming posts (if applicable).
    • If your local law permits, record abusive phone calls.
  3. Initiate a Fraud Alert: If a caller is operating from a mobile number not linked to the bank’s official contact system, inform the bank immediately that a number is being used to conduct a fraudulent recovery attempt against your account.

 

Step 3: File a Complaint with the Bank and Regulator

 

Your bank is ultimately responsible for the conduct of its agents, even the fraudulent ones.

  1. Complaint to the Bank: Send a formal complaint (via email or registered post) to the bank’s Grievance Redressal Officer (GRO). Detail the fraudulent attempt and attach all the evidence from your log.
  2. Escalate to the RBI Ombudsman: If the bank fails to respond within 30 days or provides an unsatisfactory resolution, immediately file a complaint under the Reserve Bank of India (RBI) Integrated Ombudsman Scheme (RB-IOS). You can do this online via the RBI’s Complaint Management System (CMS) portal. The RBI takes a very serious view of Bank Harassment and fraudulent collection practices.

 

Step 4: Go to the Police for Criminal Intimidation

 

If the agent’s conduct crosses the line into criminal activity, do not hesitate to involve law enforcement. This provides the highest level of Borrower Protection.

  • When to File a Police Complaint (FIR): Immediately file a First Information Report (FIR) at your local police station if the fake agent:
    • Threatens you with physical violence or harm to your family.
    • Visits your home outside the legal time window (7 AM – 7 PM).
    • Uses public humiliation (publicly sharing your debt details or calling your employer/neighbors to defame you).
    • Attempts to criminally trespass or illegally seize property.
  • Use Applicable IPC Sections: A police complaint can be filed under relevant sections of the Indian Penal Code (IPC), such as those for criminal intimidation or insult.
